The sale of all equipment described herein is conditioned upon theTerms and Conditions contained herein. Any additional or different terms thatare proposed by the customer are hereby objected to and will not be bindingupon Liberty Test Equipment unless specifically agreed to in writing by LibertyTest Equipment. Any order for or any statement of intent to purchase hereunderor any direction to deliver equipment shall constitute the customer\'sacceptance of all of Liberty Test Equipment\'s Terms and Conditions that arestated herein.

SHIPMENT

F.O.B. point is Liberty Test Equipment\'s Inventory Center fromwhich the shipment is made. Shipment will be made at the customer\'s expense inaccordance with Liberty Test Equipment\'s standard shipping and handlingcharges. The seller will not be responsible for damage to uninsured shipments.

EXCUSABLE DELAYS

Delivery dates are approximate. Liberty Test Equipment shall notbe liable for delays in shipment due to causes beyond its reasonable control,including but not limited to acts of God, acts of the customer, acts of civilor military authority, governmental priorities, strikes, fires, floods,epidemics, war, riot, delays in transportation or car shortages, or inabilitybecause of any cause beyond the reasonable control of Liberty Test Equipment toobtain necessary materials, components, services or facilities. In the event ofsuch delay, the date of the shipment shall be extended for a period equal tothe time lost by reason of such delay.

PAYMENT

Payment shall be in advance of shipment. Liberty Test Equipmentaccepts Paypal, Visa, MasterCard, American Express, and Discover. All paymentsare to be made in U.S. dollars.

CUSTOMER\'S OBLIGATIONS

The customer agrees to and shall be fully responsible for any lossof, or damage to, the equipment for any cause whatsoever. The customer shallpay all repair costs for any loss of, or damage to, the equipment.

WARRANTY

Liberty Test Equipment warrants this equipment to the customer for180 days against any defective parts and for labor costs. Liberty TestEquipment also warrants that the equipment shall be shipped in good operatingcondition. However, if the shipped equipment is not in good working conditiondue to no fault of the customer, then the customer shall notify Liberty TestEquipment within three (3) days after receipt of the equipment. Liberty TestEquipment shall, at its option, either repair the equipment or supply replacementequipment subject to availability. The customer shall be responsible forshipping the equipment and paying the shipping costs back to Liberty TestEquipment, then Liberty Test Equipment shall then repair or replace theequipment, and pay shipping costs to provide the customer with repaired orreplaced equipment. The foregoing warranty is in lieu and exclusive of allother warranties, whether express, implied or statutory, oral or written.Unless otherwise agreed in writing, Liberty Test Equipment does not warrant themerchantability of the components furnished or the equipment sold, or itsfitness or suitability for any specific application or use. Liberty TestEquipment shall not be liable for any damage or losses regardless of reason orcause for its failure to discover, report, repair or modify latent defects ordefects inherent in the design of the equipment. Any warranty and right ofreturn explicitly included in the description for a specific listing supersedesthe aforementioned warranty clause.

The foregoing shall constitute the sole remedy of the customer and the sole liabilityof Liberty Test Equipment.
